Mobio Games – TERMS OF SERVICE

IMPORTANT NOTICE: PLEASE READ CAREFULLY. These Terms of Service (“Terms”) are a legal agreement between you (“you”, “player”) and Mobio Games (“Mobio”, “we”, “us”, “our”), an entity established in Istanbul, Türkiye. By downloading, installing, accessing or using any Mobio mobile game, website or related feature (collectively, the “Service”), you agree to be bound by these Terms and our Privacy Policy. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
1. PARTIES & SCOPE
These Terms apply to all use of the Service worldwide. Additional country‑specific disclosures required by local law appear in Annex A.
2. ACCOUNT REGISTRATION & SECURITY
• You may create an account via Google Sign‑In or e‑mail.
• You must provide accurate information and keep it up‑to‑date.
• Keep your credentials secret. You are responsible for all activity under your account.
• The Service is not directed to children under 13 (or the minimum digital consent age where you live). If you are under that age, you may not create an account without verifiable parental consent.
3. LICENSE
Mobio grants you a personal, non‑exclusive, revocable, non‑transferable, limited license to access and use the Service for your own non‑commercial entertainment. No title or intellectual‑property rights are transferred to you.
4. USER CONDUCT
You agree not to:
(a) Use cheats, bots, exploits, automation, or reverse‑engineer or decompile any part of the Service;
(b) Harass, bully, threaten or defame any other player;
(c) Upload unlawful, infringing, or obscene content;
(d) Use the Service for commercial purposes without our written consent.
5. VIRTUAL ITEMS
The Service may include virtual currency, characters, or items (“Virtual Items”). Virtual Items are licensed, not sold. They have no real‑world value, are non‑refundable, and may be modified or removed by Mobio at any time.
6. PURCHASES, FEES & REFUNDS
In‑app purchases are processed by Google Play Store / Apple App Store. The store’s billing terms, including refund rules, apply. For incorrect charges contact us at mobiogamestudio@gmail.com within 48 hours.
7. THIRD‑PARTY SERVICES
The Service integrates Firebase Analytics, Google AdMob, and Meta Audience Network SDKs to provide analytics, crash reporting, and advertising. Your use of those components is subject to the providers’ own terms.
8. DATA & PRIVACY
Our data practices are described in the Mobio Games Privacy Policy, which is incorporated by reference.
9. WARRANTY DISCLAIMER
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR‑FREE.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Mobio will not be liable for any indirect, incidental, special, punitive or consequential damages. Our total cumulative liability arising out of or relating to the Service shall not exceed one hundred U.S. dollars (USD 100).
11. INDEMNITY
You agree to defend, indemnify and hold Mobio harmless from any claim, loss, liability, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Service.
12. TERMINATION
We may suspend or terminate access to the Service at any time for any reason (including but not limited to a breach of these Terms). Upon termination, the license granted to you ends and you must delete all copies of our software.
13. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict‑of‑laws rules. All disputes shall be submitted to the exclusive jurisdiction of the competent courts of Istanbul (Çağlayan), Türkiye. Consumers in the EU/EEA may be entitled to raise disputes via an alternative dispute‑resolution body or the EU Online Dispute Resolution platform.
14. CHANGES TO THE TERMS
We may modify these Terms from time to time. We will notify you of material changes in‑game or on our website. Continued use of the Service after changes take effect constitutes acceptance.
